Is Gale Bertram Red John?

He wasn't one of Red John's men. He was part of Red John's corrupt organization, As you see in the episode where Jane killed Red John and the episode before that, Bertram is part of that organization and tries to kill Jane because he found out about the organization and some of its members.

How does Red John know Jane's list?

They got inside the building by pretending to fix the AC that was broken (mentioned in the episode). They took videos and photos of Jane's work so the inside man knew everything. Pretty sure he reported it to Red John so that's how he ended up having that list. What did Red John do to Kristina Frye? It seems that Frye has been hypnotized by Red John into believing she is dead and has passed over to the spirit world. Kristina was the first date for Patrick since his wife's death.
